TERMS OF SERVICE.

Plume ("Plume", "the Service") is operated by E2 Partners LLC, a company registered in the Dubai Meydan Free Zone, United Arab Emirates ("E2 Partners LLC", the "Company", "we", "us"). By creating an account or using the Service, you agree to these Terms of Service, our Privacy Policy, our Acceptable Use Policy, and our Refund Policy, each incorporated by reference. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of majority in your jurisdiction, and legally able to enter into this agreement. If you use the Service on behalf of an organization, you represent that you are authorized to bind it to these Terms.

Plume provides access to third-party and open-source artificial intelligence models for generating images, video, audio, and text, through our web interface and API. E2 Partners LLC is a technology provider and intermediary; it does not create, author, endorse, or publish the content that users generate, and the models are operated by their respective providers.

We may add, change, suspend, or discontinue any part of the Service, including specific models, at any time without liability.

You are responsible for your account, your credentials, your API keys, and all activity that occurs under them. Keep your keys secret and notify us immediately of any unauthorized use. We may rate-limit, suspend, or revoke access to protect the Service.

The Service does not include free, trial, or signup credits — access to generations requires purchased credits. Credits are purchased in advance through our payment processor (Stripe) and are consumed as you run generations, at the rate shown for each model or effect. Prices and rates may change at any time. Credits are not legal tender, carry no cash value outside the Service, are non-transferable, and expire 12 months after the date of purchase.

Refunds are governed solely by our Refund Policy. Credits consumed by completed generations are non-refundable, including where you are dissatisfied with an output.

Your use of the Service is governed by our Acceptable Use Policy, which prohibits (among other things) illegal content, content that infringes others' rights, non-consensual intimate imagery, any sexual content involving minors, and deceptive or harmful deepfakes of real people.

You are solely responsible for the prompts and inputs you submit and the outputs you generate, and for ensuring your use complies with all applicable laws and the underlying model licenses. We may remove content, and suspend or terminate accounts, that violate the policy, and may cooperate with law enforcement where required.

You retain ownership of the prompts and inputs you submit and, to the extent permitted by the underlying models' licenses and applicable law, the outputs you generate. You represent and warrant that you own or have all rights, consents, and permissions necessary for any content you upload — including any real person's image, likeness, or voice — and that your inputs and outputs do not infringe any third-party rights or violate any law.

You grant E2 Partners LLC a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your inputs and outputs solely as necessary to operate, secure, and improve the Service — including, where you choose to make a creation public, displaying it in public areas of the Service.

Outputs are generated by probabilistic AI models and may be inaccurate, incomplete, offensive, biased, or infringing, and may not be unique to you. They are provided for your independent evaluation. Outputs do not constitute professional advice of any kind (including legal, medical, financial, or safety advice), and you must not rely on them as such. You are solely responsible for reviewing, verifying, and deciding how to use any output.

The Service depends on third parties, including AI model providers and payment processors, each acting under its own terms and privacy practices. E2 Partners LLCdoes not control and is not responsible or liable for the acts, omissions, availability, outputs, security, or policies of any third party, and your use of the Service is also subject to those parties' terms.

The Service itself — including the Plume name, interface, software, and design — is owned by E2 Partners LLC and its licensors and is protected by intellectual-property laws. Except for the rights expressly granted here, we grant you no license to our marks or technology. You may not copy, resell, reverse-engineer, scrape, or build a competing service from the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. E2 Partners LLCDOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY OUTPUT WILL MEET YOUR REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, E2 Partners LLC AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THE SERVICE OR ANY OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You will defend, indemnify, and hold harmless E2 Partners LLC and its owners, officers, directors, employees, affiliates, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your inputs, outputs, or use of the Service; (b) your violation of these Terms or any law; or (c) your infringement or violation of any third-party right.

We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms or to protect the Service or other users. You may stop using the Service and close your account at any time. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, without regard to conflict-of-laws rules. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to that venue. You agree to bring claims only in your individual capacity and not as part of any class or representative action.

We may update these Terms; material changes will be posted here with a new date, and your continued use after changes take effect constitutes acceptance.
